These Terms of Service ("Terms") form a binding agreement between you (or the entity you represent) and Crystl AI governing your access to and use of our website, applications, and APIs (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Crystl AI provides an AI-powered platform to plan, generate, and optimize marketing campaigns. We may improve, change, or discontinue features over time. Beta features are clearly labeled and provided "as is".
2. Accounts
- You must be at least 16 years old and able to form a binding contract.
- You are responsible for everything that happens under your account and for keeping credentials secure.
- You must provide accurate information and notify us of unauthorized access.
3. Your Content
You retain ownership of the briefs, brand inputs, prompts, and assets you submit or generate using the Service ("Customer Content"). You grant Crystl AI a worldwide, non-exclusive license to host, process, transmit, display, and create derivatives of Customer Content solely to operate, secure, and improve the Service for you.
You are responsible for Customer Content and for ensuring you have the rights necessary to submit it and to use the outputs.
4. AI-Generated Output
The Service uses AI models to produce text, images, plans, and other outputs ("Output"). To the extent permitted by law and as between you and us, you own the Output you generate. AI models can produce inaccurate, incomplete, or biased results. You are responsible for reviewing Output before relying on or publishing it. Output may not be unique - similar prompts can yield similar results across users.
5. Acceptable Use
You agree not to:
- Use the Service to violate laws, infringe rights, or harm others.
- Generate content that is unlawful, defamatory, deceptive, hateful, sexually explicit involving minors, or designed to facilitate fraud, malware, or harassment.
- Attempt to reverse engineer, scrape, or interfere with the Service or its security.
- Resell, sublicense, or use the Service to build a competing product.
- Submit content containing malware or another person's confidential or personal data without authorization.
6. Plans, Billing, and Trials
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing for future billing periods with prior notice. Free plans and trials may have usage limits and may be discontinued at any time.
7. Suspension and Termination
You may cancel at any time from account settings. We may suspend or terminate access if you breach these Terms, create risk to the Service or other users, or fail to pay fees. Upon termination, your right to use the Service ends; sections that by nature should survive will survive.
8. Confidentiality and Privacy
Each party will protect the other's confidential information. Our processing of personal information is described in our Privacy Policy.
9. Disclaimers
The Service and Output are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that Output will be suitable for any specific use.
10. Limitation of Liability
To the maximum extent permitted by law, Crystl AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability arising out of or related to the Service will not exceed the amounts you paid to us in the twelve months before the claim, or USD 100 if you are on a free plan.
11. Indemnification
You will defend and indemnify Crystl AI against claims arising from your Customer Content, your use of Output, or your breach of these Terms.
12. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-product. Your continued use after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Crystl AI is incorporated, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located there, unless mandatory local law requires otherwise.
